The following Sweepstakes Official Rules (“Official Rules”) apply to your participation in the Sponsor 2023 Academy Air Sweepstakes (the “Sweepstakes”) offered by ZCS Visionary II, LLC  d/b/a Academy Air (“Sponsor”).

Please read these Official Rules before entering the Sweepstakes. By entering into the Sweepstakes, you agree to be bound by these Official Rules and you acknowledge that you satisfy all Sweepstakes eligibility requirements.

Eligibility: This Sweepstakes is open to individual legal residents of the State of Illinois or legal residents of the State of Missouri, United States (“Sweepstakes Territory”) who are at least 18 years of age as of the date of entry. VOID OUTSIDE OF THE SWEEPSTAKES TERRITORY AND WHERE PROHIBITED OR RESTRICTED BY LAW. Officers, directors, employees, or contractors (and their immediate families and household members regardless of where they live), promotional partners, advertising/promotion agencies, and prize suppliers of Sponsor are not eligible to participate or win any prize. Employees or officials of any government entity are not eligible to participate or win a prize. The Sweepstakes, and any website pages and advertisements relating thereto, is intended for viewing only within the Sweepstakes Territory, and contestants must be present in the Sweepstakes Territory at the time they enter.

How to Enter: There are two (2) ways for eligible participants to enter the Sweepstakes for a chance to win prizes: 

1. spend $300 or more with Sponsor via service, install, or membership between August 1, 2023, and three (3) days before the next available prize listed below, at 5:59:59 p.m. CT and complete the entry form located at https://www.academyair.com/serviceentry (a “Service Entry”); or 
2. without purchase by either (but not both) (a) completeing the entry form located at https://www.academyair.com/aem (an “AEM Entry”) or (b) mailing a handwritten postcard to 2023 Academy Air Sweepstakes, 4848 Park 370 Blvd Suite F, Hazelwood, MO 63042 and providing your first and last name and email address, phone number and date of birth and stating that you have read and agree to the Official Rules and that you are eligible to enter the Sweepstakes (a “Mail-In Entry” and together with a Service Entry and an AEM Entry, each an “Entry”).  Mail-In Entries are measured in Central Time, regardless of where in the Sweepstakes Territory the eligible participant is located. Mail-In Entries must be received between August 1, 2023, and three (3) days before the next available prize listed below, at 5:59:59 p.m. CT.

Limits:

After completing any 1 of the Entries, you will be entered into a random drawing to win a Prize (defined below) in the Sweepstakes.  There is a limit of one Entry per eligible participant for the entirety of the Sweepstakes, regardless of Entry method and regardless of the number of transactions that an eligible participant completes with Sponsor during the Sweepstakes Period (defined below). After initial entry, any subsequent entry(ies) will be disqualified and any person submitting purported entries via Mail-In Entry in excess of the above-stated limit may be disqualified in Sponsor’s sole discretion.

 Sponsor reserves the right not to award any Prize. 

 

Rules of Entry: The Sweepstakes runs from August 1, 2023, to September 12, 2023, at 5:59:59 p.m. CT. (the Sweepstakes Period”). All valid entries must be submitted or received by specific dates and times listed in “How to Enter” (“Entry Deadline”) in order to be eligible for a drawing to win a Prize in the Sweepstakes. YOU WILL NOT BE ENTERED IF (1) YOU DO NOT MEET ALL OF THE ELIGIBILITY REQUIREMENTS OR (2) YOU FAIL TO COMPLETE AN ENTRY AS SPECIFIED IN THE “HOW TO ENTER” SECTION OF THESE OFFICIAL RULES.  Each winner will be notified at the email address associated with the winner’s entry. Sponsor reserves the right to cancel the Sweepstakes at any time. Entering the Sweepstakes is free—NO PURCHASE OR PAYMENT IS REQUIRED AND A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. The Sweepstakes is VOID WHERE PROHIBITED or restricted by law and is subject to all applicable federal, state and local laws and regulations. Sponsor reserves the right to ask for additional information at any time for purposes of determining Entry eligibility or fraud prevention.

Winner Selection Method: Sponsor will select one (1) winner by random drawing to win the next available prize (the “Specific Prize”) on the Selection Date set forth below for each prize, at 5:00 p.m. CT.  In an effort to reach a prize winner, Sponsor may send up to two (2) email notifications and may call the prize winner at the phone number provided upon Entry.

A prize winner will be required to express acceptance of the prize or proof of Sweepstakes eligibility and, except where prohibited by law, liability release forms provided by Sponsor or its designee in order to claim such prize winner’s Specific Prize. In the event a prize winner accepts a prize, such prize winner will not be eligible to win any other prize in the Sweepstakes. In the event a prize winner declines to accept a prize, such prize winner will remain eligible to win a prize in the Sweepstakes. Sponsor reserves the right to select an alternative potential winner, if any selected prize winner does not comply with the terms and conditions of these Official Rules.

Each prize winner will be responsible for providing a valid email address. Failure to provide a valid email address could disqualify you from winning a prize.

 

Selection of concert seat location is solely within Live Nation’s discretion.    Parking, travel and accommodations not included and are the sole responsibility of winner and guest.  Ticket delivery method is at sole discretion of Live Nation which will be either sent to winner by mail, email, mobile ticketing or placed at venue Will Call the day of concert under the winner’s name. Winner must be present to pick up tickets and a valid photo ID will be required if tickets are placed at Will Call. Winner and guest  must abide by all Venue policies. Live Nation reserves the right to revoke full or partial prize from any winner or winner’s guest who it and/or Venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, and/or may bring Venue/Live Nation into disrepute.  Winner understands that there are inherent risks involved in being in public spaces and that these risks may be present before, during and after the concert. Resale of tickets is prohibited.  By claiming tickets, you agree to Live Nation’s Terms of Use and to abide by the health and safety measures in effect at the time of your concert, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should the concert be cancelled, you will be notified as soon as reasonably possible. 

No substitution or transfer of prizes permitted, except at the sole discretion of Sponsor. If any portion of a prize is unavailable, rescheduled, cancelled, or delayed, Sponsor will have neither liability nor obligation to provide any substitute prize, whether or not accepted by a prize winner.

Each prize winner will be responsible for paying all costs and expenses related to the use of a prize including, but not limited to, applicable federal, state or local taxes, and any expenses that might reasonably be incurred by the prize winner in receiving or using the prize. Please consult a tax professional to discuss your particular situation.

Each prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). You agree that Sponsor’s decisions related to the Sweepstakes and all distribution of prizes are final. Any prize not claimed under the terms of these Official Rules may be deemed, in Sponsor’s sole discretion, to be forfeited and returned to Sponsor.  Sponsor disclaims all liability in connection with any prize winner’s concert attendance, including, without limitation, any premises liability or liability in connection with any injury, damage, or death.

Information Submitted: Except where prohibited by law, by entering the Sweepstakes, entrants grant Sponsor and its affiliates with an irrevocable, worldwide, perpetual license to use Entry information for its promotional purposes, without additional compensation, including posting in a winner’s list. Sponsor may be required to disclose the information about each winner to state regulatory authorities. You agree that Sponsor may send marketing emails to the email address and mailing address provided.

Additional Terms: By entering the Sweepstakes, you agree to comply with these Official Rules, including all eligibility requirements. All Entries will become the property of Sponsor, unless prohibited by law, and will not be returned. Each Entry will constitute an assignment of copyright or other rights associated with the Entry to Sponsor.

Sponsor is not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by entrant or not, or by any technical or human error that may occur in the processing of Entries; (b) any printing or typographical errors in any materials associated with the Sweepstakes; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any Entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury, damage, death, or bodily harm to the prize winner or any third party or any of prize winner’s property in connection with the Sweepstakes. Sponsor may, in its sole discretion, disqualify any individual found to be: (x) tampering with the Entry process or the operation of the Sweepstakes; (y) acting in violation of these Official Rules; or (z) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If you use robotic, automatic, programmed or similar entry methods, your entry will be disqualified.

The authorized email account subscriber name and email address used to enter the Sweepstakes at the actual time of entry will be deemed to be the Sweepstakes entrant and must comply with these rules in the event of a dispute as to entries submitted by multiple users having the same email account. The authorized email account subscriber is the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted e-mail addresses. All entries will be deemed to have been made by the authorized account holder of the submitted email address.   Submitting mass entries or entries generated by a script, macro or use of automated devices is prohibited and will result in disqualification.

By entering the Sweepstakes, you agree (for yourself and your heirs) that Sponsor, along with each of their respective affiliates and agents, and any entity involved in any aspect of the Sweepstakes, Live Nation Worldwide, Inc. (“Live Nation”),  and each of their respective parents, partners, divisions, subsidiaries, shareholders, officers, directors, members, managers, agents, affiliates, and employees  (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Sweepstakes, even if caused or contributed to by the negligence of any of the Released Parties. Sponsor does not endorse any opinion, recommendation, or advice provided in the Sweepstakes, and Sponsor expressly disclaims all liability in connection with such content.

Disputes. You agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in St. Louis, Missouri; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Missouri  for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant or Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Missouri the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri.

Winner’s List:  For winner’s name, send a self-addressed stamped envelope to be received by November 1st, 2021 to: 2023 Academy Air \Sweepstakes, 4848 Park 370 Blvd Suite F, Hazelwood, MO 63042.

Privacy Notice: All information submitted in connection with the Sweepstakes will be treated in accordance with these Official Rules and Sponsor’s Privacy Notice.

Live Nation is not a Sponsor of the Sweepstakes and in no way responsible for the administration of the Sweepstakes, the verification of winners or the fulfillment of prizing.  All inquiries regarding the Sweepstakes should be directed to Sponsor.
